Latin America is highly exposed to climate change, leading to human mobility patterns. Faced with the lack of specific legal instruments facilitating climate migrants' protection, human rights-based climate litigation may add to their visibility, as well as address their protection needs. The study aims to investigate how far climate litigation cases in the region deal with the distinct dimensions of human mobility, as well as Latin America's contribution in terms of human rights arguments. It identifies regional human rights arguments to cope with the current climate crisis that can be raised in litigation cases on the topic, such as the right to a safe climate, the extraterritoriality of human rights obligations and more recently the right not to be forcibly displaced. A categorization of climate litigation addressing the distinct dimensions of human mobility is presented. This categorization is divided according to the degree of consideration of the phenomenon, the type of litigation and the arguments invoked. The study then analyzes specific climate litigation cases associated with human mobility in Latin America and its central arguments. Advances in the consideration of human mobility in climate litigation were noted, as well as Latin America's potential to advance this trend, through new interpretative and argumentative developments and litigation strategies that contextualise human rights in the face of the climate crisis and favour the protection of climate migrants. América Latina está altamente expuesta al cambio climático, que influye en los patrones de movilidad humana. Ante la ausencia de instrumentos jurídicos específicos de protección de los migrantes climáticos, el litigio climático con fundamento en los derechos humanos puede contribuir para aumentar su visibilidad y abordar sus necesidades de protección. El estudio se propone investigar el abordaje de la movilidad humana en los litigios climáticos y la contribución de América Latina en términos de argumentos de derechos humanos. Se identifican argumentos regionales de derechos humanos para el enfrentamiento de la crisis climática que pueden impulsar la consideración de la movilidad humana en los litigios climáticos, como el derecho al clima seguro, la extraterritorialidad de las obligaciones de derechos humanos y el derecho a no ser desplazado forzadamente. Se presenta una categorización de los litigios climáticos que abordan las distintas dimensiones de la movilidad humana, de acuerdo con el grado de consideración del fenómeno, el tipo de litigio y los argumentos invocados. Por fin, se analizan los litigios climáticos específicamente asociados a la movilidad humana en América Latina y sus argumentos centrales. Se constataron avances en la consideración de la movilidad humana en el litigio climático, así como el potencial de América Latina para impulsar esta tendencia, a través de nuevos desarrollos interpretativos y argumentativos y de estrategias de litigio que contextualizan los derechos humanos ante la crisis climática y favorecen la protección de los migrantes climáticos. Amèrica Llatina està altament exposada al canvi climàtic, cosa que influeix en els patrons de mobilitat humana. Davant l'absència d'instruments jurídics específics de protecció dels migrants climàtics, el litigi climàtic amb fonament en els drets humans pot contribuir per augmentar-ne la visibilitat i abordar les necessitats de protecció. L'estudi proposa investigar l'abordatge de la mobilitat humana en els litigis climàtics i la contribució d'Amèrica Llatina en termes d'arguments de drets humans. S'identifiquen arguments regionals de drets humans per a l'enfrontament de crisi climàtica que poden impulsar la consideració de la mobilitat humana en els litigis climàtics, com el dret al clima segur, l'extraterritorialitat de les obligacions de drets humans i el dret a no ser desplaçat forçadament. Es presenta una categorització dels litigis climàtics que aborden les diferents dimensions de la mobilitat humana, segons el grau de consideració del fenomen, el tipus de litigi i els arguments invocats. Finalment, s'analitzen els litigis climàtics associats a la mobilitat humana a Amèrica Llatina i els seus arguments centrals. Es van constatar avenços en la consideració de la mobilitat humana en el litigi climàtic, així com el potencial d'Amèrica Llatina per impulsar aquesta tendència, a través de nous desenvolupaments interpretatius i argumentatius i d'estratègies de litigi que contextualitzen els drets humans davant de la crisi climàtica i afavoreixen la protecció dels migrants climàtics.
