Two problems are involved in the disciplinary regime: first as a disciplinary tool because public servers tends regulate their conduct within the civil service, and the second as a means of "Deviation of Power", used to to persecute, harass and make the server resign for not being party boss. The object of the research is to determine the current disciplinary system within the Disciplinary Law, by which a public servant of the state may be subject to sanctions, suspension and removal from office. Legal research partner looking to meet the right discipline, its impact on the population of public servants; type explanatory research. As a result it has a disciplinary system that reviews the conduct of public servants and individuals exercising public functions. The conclusion: the failure of functional duty is to guide the determination of the unlawfulness of the conduct that are blamed for the disciplinary law. The dosage of Punishment can not continue being at the discretion of the holder of the disciplinary action and less when the second instance is brought before it. ; Dos problemas están inmersos en el régimen disciplinario: el primero como herramienta disciplinaria que propende porque los Servidores públicos regulen sus conductas dentro de la función pública, y el segundo como medio de "Desviación del Poder", utilizado para para perseguir, acosar y hacer que el servidor renuncie por no ser del partido de su jefe. El Objeto de la investigación es Determinar el régimen disciplinario vigente dentro del Derecho Disciplinario, por el cual un servidor público del Estado puede ser objeto de sanciones, suspensión y de destitución de su cargo. Investigación socio jurídica que busca conocer el derecho disciplinario, su impacto en la población de servidores públicos; investigación de tipo explicativo. Como resultado se tiene un régimen disciplinario que revisa la conducta de los servidores públicos y de los particulares que ejercen funciones públicas.
