This article analyzes speculative and hoarding behaviors within the Open Access Regime from a regulatory perspective, considering the origin of this framework and its effects on competition and sector development. Based on the applicable regulations and case law of the Panel of Experts, it argues that such behaviors undermine the purposes of the regime and hinder the entry of new participants. Finally, it maintains that there is an implicit proscription of these acts within the current legal framework. ; El presente artículo analiza las conductas de especulación y acaparamiento en el Régimen de Acceso Abierto, desde un enfoque regulatorio, considerando el origen de este régimen y efectos sobre la competencia y el desarrollo del sector. A partir de lo anterior, la normativa y jurisprudencia del Panel de Expertos, se sostiene que dichas conductas vulneran los fines del régimen y obstaculizan el ingreso de nuevos actores. Finalmente, se sostiene la existencia de una proscripción implícita de estos actos en la normativa vigente. |
