Er bedauert, dass einige andere grundlegende Fragen im Zusammenhang mit der beabsichtigten Strenge und den Gründen für die verschuldensunabhängige Haftung nicht angesprochen wurden. ; This article analyses the recently adopted Product Liability Directive, exploring the background and reasons for the new instrument and the changes ushered in by the new rules. These modifications impact on key aspects of the liability regime including the expanded concept of a product, the notion of defect, recoverable harm, burden of proof and related evidential matters. It regrets that some other fundamental issues relating to the intended strictness and rationales for strict liability were not addressed. ; En este artículo se analiza la Directiva de responsabilidad por productos recientemente adoptada, se exploran los antecedentes y las razones de este nuevo instrumento y los cambios introducidos por las nuevas normas. Estas modificaciones afectan a aspectos clave del régimen de responsabilidad, como el concepto ampliado de producto, la noción de defecto, el daño indemnizable, la carga de la prueba y las cuestiones probatorias relacionadas.
