In the field of electricity, the Technical Rules issued by the National Energy Commission have emerged in recent years as one of the most significant regulatory instruments within the sector, considering their scope, the extent of their purpose, as well as their significant increase, both in number and in the matters regulated by them. Given their strategic importance, this article analyzes the main elements of the Technical Standards, in addition to their legal nature, raising the need of implementing a specialized control mechanism to ensure an adequate review of the content and legality of these standards. ; En materia eléctrica, las Normas Técnicas dictadas por la Comisión Nacional de Energía se han erigido, en los últimos años, como un instrumento regulatorio relevante del sector, considerando su alcance y la amplitud de su objeto, así como su notable incremento tanto en número como en las materias reguladas por éstas. Dada su importancia estratégica, en el presente artículo se analizan los principales elementos de las Normas Técnicas, así como su naturaleza jurídica, planteándose la necesidad de implementar una instancia de control especial que permita efectuar adecuadamente una revisión del contenido y legalidad de estas normas. |
