In “Buckley at 50: By What Right?” Lawrence Lessig explores the concept of “corruption” in Buckley v. Valeo and how it has impacted the modern American campaign finance regime. First examining the origins of Buckley, he clarifies its scope and explains some respects in which First Amendment jurisprudence has developed over time, paying special attention to how the First Amendment interacts with super PACs. He then argues that Citizens United is correct under the conception of corruption embraced by Chief Justice Roberts, and why SpeechNow v. FEC is not. Finally, arguing from an originalist perspective, Lessig argues in both the radical originalist mode of Justice Thomas and a more moderate originalist mode that Congress is, in fact, more broadly empowered to regulate in limitation of corruption than is commonly accepted. |
