This article aims to problematize the idea of free market and competition, contrary to state interventionism and planning, based on the logic of neoliberal fiscal austerity, as the most appropriate way to promote the foundations and purposes of the Republic and the Economic and Social Orders. To this end, the controversy surrounding the validity of the concept of neoliberalism as a category of analysis by the social sciences and its contribution to restructuring the State is exposed, taking into account studies in the area of economics based on empirical evidence, it is discussed expansionist fiscal austerity and its reverse effect on the worsening of the fiscal situation, causing the stagnation of the economy at the cost of state limitation, in addition to presenting how the adoption of an economic regime and model has contributed to aggravate the distancing of constitutional political-normative guidelines, being It is necessary to implement an economic regime and model that are compatible with the objectives and purposes of the Republic and the Economic and Social Orders of CRFB/1988. The article takes an interdisciplinary approach between law and economics, methodologically involving legal-social, qualitative and bibliographical research. ; Este artigo tem por objetivo problematizar a ideia de livre mercado e concorrência, avessa ao intervencionismo e planejamento estatais, pautada na lógica de austeridade fiscal neoliberal, como forma mais apropriada para promover os fundamentos e finalidades da República e das Ordens Econômica e Social. Com esse fim, expõe-se a controvérsia acerca da validade do conceito do neoliberalismo enquanto categoria de análise pelas ciências sociais e a sua contribuição para reestruturar o Estado, levando-se em conta estudos da área da econômica baseados em evidências empíricas, discute-se a austeridade fiscal expansionista e o seu efeito reverso no agravamento do quadro fiscal provocando a estagnação da economia ao custo da limitação estatal, além de apresentar como a adoção de ... |
